Text and music protection

In France, any original creation is protected by copyright. The laws of March the 11th of 1957 and July the 3rd of 1985 mention the exclusive ownership of the work by its creator, its sole right of exploitation and its right of authorization or refusal of use. Articles L.111-1 and L.123-1 of the Intellectual Property Code specify that the author has exercised his music copyright throughout his life. Upon his death, this right is passed on to his heirs for a period of 70 years. The protection of music is therefore expected from the creation of the operation, even though it is better to prove the ownership of its production by safer means.

Musical rights

As previously explained, music rights are obtained by the copyright method. In order to reliably protect their creation, however, it is in the interest of authors to file a music application or copyright with organizations, departmental officers or companies specialized in the protection of music copyright. The authenticity and the ownership of a musical work can thus be protected by the SACEM (Society of Authors, Composers and Music Publishers) on the condition of depositing at least 5 pieces of work of which one is already operated. The SNAC (National Union of Authors and Composers) and the INPI (National Institute of Intellectual Protection) also provide music protection as bailiffs and notaries. These steps have a cost for the author and the protection of musical rights is more or less long and extended depending on the chosen intermediary. It should be noted, however, that SACEM is responsible for the authorship of the work and management of the payment of rights (the most famous "copyright").
